Complaint: Due to lengthy divorce proceedings and extended unemployment a foreclosure occurred on the marital residence. Specifically, the foreclosure occurred because my ex-spouse refused to sign a deed-in-lieu, or cooperate in the short-sale process. The property was sold at or near the loan amount. Any short fall was guaranteed by VA and the lender suffered no loss. The date of the foreclosure was XXXX/XXXX/2015.
However, I understand the reporting of this item and I 'm providing this for background information to the following : There was a second mortgage in the form of a home equity line of credit. The mortgage holder was First Tennessee Bank. The maximum amount of this loan was {$25000.00}.
The amount at time of foreclosure was {$8800.00}. Thirty days after the foreclosure, XXXX 2015 the entire of {$8800.00} was charged-off by First Tennessee and states on my credit report " charge off due to loss ''. At the time of the charge off, and at least sixty days prior to, this account was current with no delinquency and in good standing. As the payments were on auto pay I was n't informed of the charge off until I called First Tennessee in XXXX 2015 asking why I was no longer receiving statements. At that time I was asked to participate in a repayment plan which I have followed as agreed since XXXX 2015.
Recently I attempted to obtain housing by leasing an apartment. The application was denied based on the level of charge offs. There are several points where I have been affected negatively by false information or actions of First Tennessee : 1. There was no financial loss by First Tennessee and the charge off was discretionary by First Tennessee based on the loss of collateral.
2. First Tennessee never attempted to convert this loan to another instrument or provide any options before taking adverse action against me.
3. First Tennessee continues to report this account to credit reporting agencies as a charge off each and every month and refused to explain the correct nature of their initial actions.

Complaint: I am submitting this complaint on behalf of my step father. His concern is in regards to the credit decision as well as problems paying this loan. He is unable to adequately read such documents that were presented to him and he did n't clearly understand all the terms or conditions that applied. But mostly, after reviewing this type of loan ( HELOC ) that was presented to him, I strongly feel that his level of education, limited income, age, as well as all the time and all the sacrifices he will have to make in the time allowed to satisfy the loan terms, maintain his home so that he may comfortably live out his days without leaving a burden upon his wife, kids, or grandchildren did not get taken into consideration. Either overlooked. Now that he is unable to pay such a variable rate loan, foreclosure is being presented. Which leads me to question the decision of this loan. Also Now that he is unable to pay such a variable rate loan, he is faced with the fear of foreclosure.

Complaint: Hello, I am in need of some help with a second mortgage loan issue. I filed for Chapter XXXX Bankruptcy and it was discharge XX/XX/XXXX. I included both my first and second home mortgage loans. I moved out of the property. XX/XX/XXXX the mortgage company holding my first mortgage, XXXX offered me a Government refinance loan and I accepted the offer nothing was ever mentioned about or concerning the second mortgage note. I have made on time payments ever since. The Second Mortgage with Horizon Home Loans was never mentioned, I have never made any further payments to the second mortgage since my Bankruptcy XX/XX/XXXX. Fast forward to now, I am XXXX and live on a fixed income and in need of repairs to this home at XXXX XXXX XXXX, XXXX CA XXXX. My only option is to finance the repairs, however the second mortgage loan is still showing without reconveyance or quit deeded. I have made several attempts to contact First Horizon Home Loans without a single reply from. I have filed a BBB complaint with them without any response as well. My current mortgage loan company XXXX which now also owns First Horizon Home Loans has had no reply or help as well. It is like these mortgage companies do not want to discuss or fix this problem.
