Complaint: I've reached out to SunTrust BanksXXXX Acct # XXXX and i asked them about the account that was reporting on my consumer report and that i was reaching out to them to get the account resolved i was told that they no longer had the account and sold my account without my permission and without me knowing which is against my rights. By law, a consumer must receive written notice ( known as a debt validation letter ) within five days of the collector 's initial attempt to contact you. I never received an XXXX form showing that i gave SunTrust Banks/XXXX permission to do anything with my consumer report. I told SunTrust Banks/XXXX That they were violating my rights, according to 15 US code 1681a ( 2 ) ( Exclusions ) Things that aren't supposed to be included on a consumer report. Information solely as to transaction or experiences between the consumer and the person making report. Consumer- is an individual ( ME ). Person-Any individual partnership, Corporation, Trust, estate, cooperative association XXXX government or governmental subdivision or agency, or other entity. Experiences & Transaction- Applying for a loan, credit cards, late payments, high utilization, charge off ( s ), collection accounts, Judgements, Repos, Bankruptcy. and now this company think it can continue to violate my rights and keep reporting without permissible purpose of my consumer report, according to 15 US Code 1681b Permissible purpose of consumer report it states. ( a ) In GENERAL, Subject to subsection ( c ) any consumer reporting agency may furnish a consumer report under the following circumstances and no other : ( 2 ) IN Accordance with written instructions of the consumer to whom it relates. You have no permissible purpose by law to contact third parties with my private or personal information 15 USC 1681a speaks on a consumer right to privacy. I express to SunTrust BanksXXXX that this has cause a lot of damage in my life for them fraudulently sold my account without me knowing and its caused XXXX XXXX and different health issue from the effects that it has on my personal life how can i take advantage of a banking system that isn't working for me and decides to take law in their own hands and have consumers fall on the sword with their life. 15 US Code 1692d- Harassment or abuse. The advertisement for sale of any debt to coerce payment of the debt. Your offenses amount to aggravated Identity Theft pursuant to US Code 1028A and 15 US Code 1681e. You have knowingly transferred, possessed, or used, without lawful authority, a means of identification of me, which is a felony punishable with imprisonment, in addition to civil liability. For every violation i want XXXX dollars or account removed following with the accordance with 15 US Code 1681 ( n ) Civil liability of a willful noncompliance and it states a ) In general Any person who willfully fails to comply with any requirement imposed under this subchapter with respect to any consumer is liable to that consumer in an amount equal to the sum of ( 1 ) ( A ) any actual damages sustained by the consumer as a result of the failure or damages of not less than {$100.00} and not more than {$1000.00} ; or ( B ) in the case of liability of a natural person for obtaining a consumer report under false pretenses or knowingly without a permissible purpose, actual damages sustained by the consumer as a result of the failure or {$1000.00}, whichever is greater ; ( 2 ) such amount of punitive damages as the court may allow ; and ( 3 ) in the case of any successful action to enforce any liability under this section, the costs of the action together with reasonable attorneys fees as determined by the court. and this company just continues to violate me according to 15 US Code 6802 ( a ) Notice requirements Except as otherwise provided in this subchapter, a financial institution may not, directly or through any affiliate, disclose to a nonaffiliated third party any nonpublic personal information, unless such financial institution provides or has provided to the consumer a notice that complies with section 6803 of this title.
( b ) Opt out ( 1 ) In general A financial institution may not disclose nonpublic personal information to a nonaffiliated third party unless ( A ) such financial institution clearly and conspicuously discloses to the consumer, in writing or in electronic form or other form permitted by the regulations prescribed under section 6804 of this title, that such information may be disclosed to such third party ; ( B ) the consumer is given the opportunity, before the time that such information is initially disclosed, to direct that such information not be disclosed to such third party ; and ( C ) the consumer is given an explanation of how the consumer can exercise that nondisclosure option.

Complaint: Monday, XX/XX/XXXX, I was notified by my clearance investigator that I had a 30-day late payment on my credit report. I knew this was wrong because my payments are on autopay but I went online to try to make a payment anyway. The website was down so I contacted XXXX and they informed me the site would be back up the following Monday. After logging in on Monday, I still could not make a payment so I called XXXX back. I finally was able to speak to someone competent as she did some investigating and realized XXXX misapplied one of my mortgage payments to the wrong loan. This caused a 30-day late payment on my credit report. She informed me it was the bank 's fault and that they would try to fix the late notice on my credit report.
I am trying to get a personal loan and I can not with the credit score hindered by this misleading and inaccurate reported information from XXXX. This has caused some personal XXXX and distress not knowing when this item will be removed.
Please removed it from my credit report as soon as possible as this is a hindrance to my way of life and as a consumer, this is a violation that is still on my report.
