Complaint: I am writing to inquire about the lawsuit settlement that Wells Fargo agreed, I had a home mortgage with them starting in XXXX and due to financial difficulties, we had trouble paying our mortgage. Wells Fargo never offered a home modification loan and I only learned of a process or what a home modification loan was from another case that was in the newspaper. I then went to Wells Fargo to request the ability to complete a home modification. We did all the paperwork, sent it in only for Wells Fargo to have " lost '' it. We did it three times- with the third paperwork reaching them successfully only for them to deny us immediately after receiving our paperwork and offering no other options.
Prior to this I attempted to set up payments to be made to catch up the mortgage. They stated accepted the payment arrangements and when I asked if we were in danger of foreclosure, we were told no. Three days later someone came to our door and served us with foreclosure paperwork.
My Spouse filed XXXX XXXX to stop the foreclosure and allow us to attempt to rectify the situation and we started paying the mortgage again ; however, the large amount we had to pay out his check for the XXXX XXXX was difficult to manage and he had to convert to XXXX XXXX, so we could keep our house and other debt was taken care of in order to do so. But Wells Fargo started the foreclosure process again and we requested another home modification. Again denied. They had also told us that any day they would take possession of the home and everything in it as well and we would not be able to get in the home to get our items at that point. This was XXXX and we secured other residence just in case that happened as we had XXXX small children then. we went daily to the house, kept up the yard and paid the utilities. My spouse stayed there overnight. we went overnight somewhere and when we returned our home had been broken into and all the copper piping was stolen. I filed a claim to make the repairs however the check went to Wells Fargo and I had to fight them to get the repairs done. They eventually released the check, and the repairs were completed. I did seek out a lawyer, but Wells Fargo had gone way ahead on the foreclosure process. In the end they sold our house to auction, and the house was sold. To this day Wells Fargo never notified us of the sale of the house, or how much it sold for, I had learned about our house being sold on social media, because I knew the person who bought it.
we have moved and if anything was mailed to us we would not receive it as they do not have our new address. It is way past the time frame for having mail forward. Could someone please verify if we would be a claimant on the lawsuit. I called Wells Fargo and the representative stated she knew nothing about the suit.

Complaint: The Fair Credit Reporting Act ( 15 U.S. Code 1681 ) says ( 1 ) The banking system is dependent upon fair and accurate credit reporting. Inaccurate credit reports directly impair the efficiency of the banking system, and unfair credit reporting methods undermine the public confidence which is essential to the continued functioning of the banking system. So whenever there is a violation under the FCRA, it impairs the efficiency of the banking system. This is a violation of my privacy with my consumer report, since I control what is listed and what is not. In the event that any accounts are reported without my written consent, that is considered identity theft. This is a violation of both 15 U.S. Code 1681b ( 2 ) and 15 U.S. Code 1681c-2. This leads way to civil liability against the credit reporting agency for negligent and willful noncompliance under 15 U.S. Code 1681n, which allows for {$1000.00} per violation, for account listed without my expressed written consent.
